stanza

A draft, not yet in force. stanza publishes this so it can be read before it applies to anyone. Words in a [marked box] are choices not yet made. Questions or corrections: hello@stanza.pictures.

Terms of use

Last changed: [date of publication]

These terms are the agreement between you and [who runs stanza: the same as loupe’s] (“stanza”, “we”). They cover app.stanza.pictures, where rooms are made and read, and stanza.pictures. The privacy page is part of them.

If you came in with loupe, your loupe account, your pictures and your loupe site are covered by loupe’s terms (loupe.pictures/terms). Where stanza’s terms and loupe’s both speak to the same thing, [whichever is more generous to you applies].

If you signed up on stanza’s own pages, these terms and the privacy page are the whole of it. loupe keeps your account and your pictures for stanza, as one of the providers the privacy page names.

By making an account, signing in, or reading a room shared with you, you agree to these terms.

The short version

  • What you make is yours. Your rooms, your words and your pictures stay yours. We hold them only to run stanza for you.
  • Three doors in: with a loupe membership, which includes stanza; on stanza’s own pages, as a writer [once stanza opens to writers]; or as a reader, named by someone to read a room.
  • Your pictures are kept in loupe, never on stanza’s server.
  • Nothing of stanza’s on your room. On your site, a room carries no credit, mark or link of ours.
  • A room you share with readers isn’t published. Only the people you name can read it.
  • Use only what you have the right to use, and nothing on the list in section 8.
  • stanza is still being built. Keep your own copy of your words.

1. Words used here

  • Room: a page you make in stanza from your pictures and your words, laid out with stanza’s moves.
  • Your words: your poems and essays in My poems and My essays, and the words in your rooms.
  • Your work: your rooms, your words, what you write about your pictures, your crops, and your choices of moves and looks.
  • Reader: someone you name, by email, to read a room of yours that isn’t published.
  • Your library: where your pictures are kept, in loupe.
  • Your loupe site: the site loupe serves for a loupe member.
  • The examples: the pictures and words stanza gives every new home, to try the moves with.

2. Who may use stanza

  • You must be at least 18 to make rooms.
  • With a loupe membership. A paid loupe plan includes stanza. You sign in with your loupe account, and loupe keeps your account, your password and your plan, under loupe’s terms. There is one home for each loupe catalogue: anyone loupe lets manage your catalogue can open and change its rooms in stanza. You choose who that is, in loupe.
  • On stanza’s own pages, as a writer, once stanza opens to writers. You give your name and an email address you read, and choose a password. loupe keeps the account for stanza, behind stanza’s pages; you deal only with stanza.
  • stanza’s own sign-in is for the person who runs stanza, and the few accounts made by invitation before stanza opened to loupe members. stanza makes no new invitations.
  • Readers need no account of their own. A reader reads the rooms shared with them, and does nothing else there. Sections 5, 8 and 9 apply to readers too.
  • Keep your password to yourself. You’re responsible for what’s done with your account, except where stanza’s own failure caused it.

3. Paying

  • stanza takes no payment today. With a loupe membership, stanza comes with your paid loupe plan, under loupe’s terms.
  • stanza on its own will have a price. Before anyone is charged, this section will say what it costs, what it holds, and how renewing, cancelling and refunds work, with the notice section 13 gives. Payments will be taken by Stripe, in stanza’s name; stanza will never see or keep your card number.

4. Your work, and what you let us do with it

  • You own your work. stanza claims no ownership of anything you make or put in stanza.
  • The permission you give us is narrow. You let stanza store your work, copy it, and draw it into pages for you and the readers you name. stanza may also measure your pictures’ colors and shapes to lay out a room, make a share picture from a room’s opening picture, and keep a nightly copy to recover from failure. All of it only to run stanza for you, and only as your choices direct.
  • *When you click Add to my loupe site,* you ask stanza to send that room to loupe, to become a draft page of your site. It goes public only when you put it on your site in loupe.
  • We don’t sell your work or license it to anyone, or use it to train software. We don’t put it in stanza’s examples, or use it to show or advertise stanza, without asking you first. Your work never appears in another person’s examples.
  • Nothing of stanza’s on your room. A room on your site carries no credit, mark or link of stanza’s. Visitors see your work alone.
  • Your words are kept as you type them, with two exceptions. When you click Keep, stanza corrects clear typing slips: two or three hyphens become a dash, three dots an ellipsis, straight quotes turn the right way, doubled spaces become one. Each poem has a switch, auto-correct: turn it off, and the poem is kept exactly as typed. And spaces at the ends of lines, and blank lines before the first and after the last, are let go. Each time you change your words, the words before are kept as a version, for you alone.
  • The permission ends when your work is deleted from stanza: at once on stanza’s server, and from the nightly copies as they age out, normally within 15 days. A room already on your loupe site stays there until you take it off in loupe, and what a reader has already read stays with them.
  • You confirm you have the right to use everything you put in stanza: your pictures and any photograph someone else took, your words, and any video or route you add. A poem or passage by someone else needs its rights holder’s permission, unless it is in the public domain.
  • People pictured. You confirm you have whatever consent the law requires to show the people in your pictures as you choose.
  • Videos and routes are shown from YouTube, Strava and AllTrails, under their own terms. What a route shows of where it went is set at Strava or AllTrails; stanza adds nothing and takes nothing away.

5. Sharing a room with readers

  • A room shared with readers isn’t published. Only the people you name can open it, up to twelve for a room, each with the link in their letter and a password of their own. The link lets in whoever opens it first, so it shouldn’t be passed on. Search engines are kept from it.
  • Name only people who’d expect to hear from you. Each gets a letter from stanza in your name, and a reply reaches you. Readers see your name, and your address as the reply address of their letter (for a loupe catalogue, the address of whoever signed in last).
  • You can take a reader off at any time, and they can no longer read the room. It doesn’t undo what they’ve read: no page can stop someone copying what’s shown on a screen.
  • If you’re a reader: read for yourself. The room’s words and pictures belong to the person who shared it, so don’t copy them on, or pass the link in your letter or your password to anyone. You can ask to be taken off at any time[, or click Take me off].
  • Showing a poem before it’s published. stanza puts nothing of yours in public unless you do. Many journals count a poem shown in public as published, and some count a poem shared privately too: check a journal’s own rules before you share a poem you mean to send it.

6. Your pictures, and loupe

  • With a loupe membership, your pictures live in your library in loupe, under loupe’s terms and privacy page. stanza reads them only for your own rooms.
  • On stanza’s own pages, your pictures are kept for stanza by loupe, under these terms and stanza’s privacy page.
  • stanza adds a picture only when you add it yourself, with Add pictures or by dropping files on My pictures. The file goes from your browser straight to loupe, as it is. stanza never changes or deletes a picture in your library.
  • A picture you delete in loupe keeps its place in your room in stanza, and the place says it was deleted. Choose another there; until you do, the room can’t be added to your loupe site.
  • A room on your loupe site is a page of your site. loupe serves it, under loupe’s terms. A change you make in stanza goes to loupe as a new draft when you add the room again; the page on your site stays as it was until you accept the new one in loupe. To take a room off your site, do it in loupe.

7. stanza’s examples, and stanza’s own work

  • Every new home comes with stanza’s examples: Todd Stabley’s photographs, to try each move before your own pictures are in, and Examples, every move drawn with his pictures and Walt Whitman’s poems.
  • The photographs stay his. Use them in stanza to try the moves. A room that uses one can’t go to your site: stanza won’t send it.
  • Walt Whitman’s poems are in the public domain.
  • The pictures and words on stanza.pictures belong to Todd Stabley, or to the people credited beside them.
  • stanza’s moves, looks and software stay stanza’s. A room you make may wear them wherever you put it.

8. What stanza is for, and what it isn’t

stanza is for making rooms of your own pictures and words, and for keeping your writing. Don’t use it to:

  • put in work you don’t have the right to use, or infringe anyone’s copyright, trademark or privacy;
  • post anything illegal, including sexual content involving minors, which we report to the authorities;
  • harass, threaten or deceive people, or pretend to be someone else;
  • send letters through Readers to people who haven’t asked to hear from you;
  • probe, overload or get around stanza’s security or limits, or reach another person’s rooms, words or pictures;
  • store files that have nothing to do with your rooms or your writing.

10. Pausing an account

  • We may pause an account if it breaks section 8, if the law requires it, or if it puts stanza or other people at risk. stanza keeps a record of each pause, with the reason given.
  • Pausing signs the account out everywhere at once and keeps it from signing in, and its rooms close to their readers. Nothing is deleted.
  • The sign-in page tells you the account is paused. Write to hello@stanza.pictures to ask why, or to ask for a review.
  • A loupe account is loupe’s to pause, under loupe’s terms.

11. Ending your account

  • You can stop at any time. Sign out; nothing more is needed.
  • To delete your work: if you came in with loupe, click Delete my rooms on your account page; with stanza’s own sign-in, click Delete my account; as a writer, write to hello@stanza.pictures from your address. Your rooms, words, picture notes, readers and settings go from stanza’s server at once, and leave the nightly copies as those age out, normally within 15 days. If you came in with loupe, a short record of the deletion stays, as the privacy page says.
  • Deleting your rooms doesn’t touch loupe: not your library, not your loupe account, and not a room already on your loupe site. Take a room off your site in loupe. While your plan includes stanza, signing in with loupe again starts a new, empty home.
  • If your loupe plan stops including stanza, you can’t sign in to stanza until it does again. A sign-in already open runs to its end, at most 30 days. Your rooms stay as they are, ready when your plan includes stanza again; write to us to have them deleted sooner.
  • If your loupe account is closed, stanza isn’t told yet. Your home stays until you, or loupe, ask us to remove it.
  • We may end an account that seriously or repeatedly breaks these terms, or that a court or the law requires us to end. [Where the law allows, we offer you a copy of your words and rooms first.]
  • There’s no download of your work yet. Until there is, write to us and we’ll send you a copy of your words and rooms.

12. If stanza changes or closes

  • Closing. If stanza is going to stop, we’ll tell everyone who makes rooms at least [six months] ahead. Until then your rooms and words stay as they are, and before anything goes we offer each person a copy of their words and rooms. A room on a loupe site is loupe’s, and stays.
  • Changing hands. If stanza passes to another company or person, these terms go with it, and you get the notice in section 13 before anything in them changes.

13. Changes to these terms

  • We’ll write to you at the address kept for your rooms, and say so in stanza, at least [60 days] before a change that affects you takes effect, and say what’s changing.
  • A wording fix that doesn’t change what anything means may be made with a note on this page.
  • We will not change these terms to weaken your ownership of your work, to put anything of stanza’s on your room, or to take away the copy and the notice in section 12.

14. What we can and can’t promise

  • stanza is still being built. It says plainly what isn’t there yet. Things will change, and some will break.
  • Keep your own copy. Keep your words somewhere of your own: stanza’s nightly copy is for stanza to recover from failure, not a copy you hold, and stanza can’t yet give you a download. Keep your own masters of your pictures, too.
  • As it is. Apart from the promises in these terms, stanza is provided as it is and as available, without other warranties, as far as the law allows. [A lawyer’s wording.]
  • Limit of liability. As far as the law allows, stanza isn’t liable for indirect or consequential losses, or for the loss of work you didn’t keep a copy of. Our total liability to you is limited to [the greater of what you paid stanza in the 12 months before the claim, or $100]. Nothing here limits liability that can’t legally be limited.
  • Your responsibility. If a claim is brought against stanza because of something you put in it without the right to, or because you broke these terms, you’ll cover stanza’s reasonable costs of that claim. [A lawyer’s wording.]

15. Law and disputes

These terms are governed by the laws of [North Carolina] and the United States. [A lawyer: the courts of that state, small claims, or arbitration.] Before any formal step, write to us: most things can be settled by a letter.

16. Everything else

If part of these terms can’t be enforced, the rest still applies. Not enforcing a term straight away doesn’t waive it. You may not transfer your account without our agreement. These terms and the privacy page are the whole agreement between you and stanza; for a loupe member, loupe’s terms cover their loupe account, their pictures and their loupe site.
